When and how funds transferred in error are refunded.
Edition of 7 July 20261.1. This Refund Policy (the "Policy") governs refunds of funds transferred via the "Koldo" website to Public Fund "Cultural Center Zaytuna" (Общественный фонд «Культурный центр "Зайтуна"») (the "Organization").
1.2. A donation is a voluntary gratuitous gift for generally useful purposes (Article 518 of the Civil Code of the Kyrgyz Republic). A donation made voluntarily and knowingly is non-refundable (Article 1036(4) of the Civil Code).
The Russian text prevails; this English version is a courtesy translation.
2.1. Funds transferred in error — without the intention to donate on the given terms — are refundable, in particular: a duplicate payment of the same donation; an amount exceeding the intended one by mistake (e.g., a typo); a payment caused by a technical failure of the Website or the payment infrastructure; a payment made without the consent of the payment instrument's owner (subject to verification). The legal basis is Articles 1029–1032 of the Civil Code (unjust enrichment).
2.2. If a donation is used contrary to its designated purpose, the donor may demand revocation of the donation (Article 518(5) of the Civil Code) as provided by law.
3.1. Send a request to ⟦e-mail⟧ within 30 calendar days of the payment date, stating: payment date and time, amount, campaign name, payment identifier (from the payment confirmation), a description of the error, and your contact details.
3.2. The period in clause 3.1 does not limit rights granted by mandatory rules of the legislation of the Kyrgyz Republic.
4.1. The Organization reviews the request and replies within 10 working days of receipt. It may request additional information needed to verify the payment.
4.2. If the payment is confirmed erroneous, the refund is made to the same payment instrument used for the payment, via the Payment Provider. Crediting time depends on the Payment Provider and the payer's bank and is normally up to 30 calendar days from refund approval.
4.3. Refunds are made in Kyrgyz som in the amount transferred in error.
5.1. A refund may be refused where the payment was a voluntary and knowing donation (Article 1036(4) of the Civil Code), or where the requester is not the payer and lacks authority to act on the payer's behalf. A refusal is issued as a reasoned reply.
6.1. Questions about this Policy: ⟦e-mail, contacts⟧.
