The terms on which the Organization accepts voluntary donations through the Koldo website.
Edition of 7 July 2026Public Fund "Cultural Center Zaytuna" (Общественный фонд «Культурный центр "Зайтуна"»), registered under the laws of the Kyrgyz Republic, registration number 315369-3308-ОФ, registered address Kyrgyz Republic, Chuy Region, Alamudun District, Arashan, Atakulov Kurmanbubu St. 94 (the "Organization"), pursuant to Article 398(2) of the Civil Code of the Kyrgyz Republic (the "Civil Code"), offers to any natural person with legal capacity and any legal entity (the "Donor") to conclude a donation agreement on the terms below (the "Offer").

1.1. Website — the "Koldo" website used by the Organization as its channel for accepting Donations.
1.2. Donation — a voluntary gift of money for generally useful purposes under Article 518 of the Civil Code.
1.3. Campaign — a charitable program of the Organization published on the Website, describing its purpose, target amount, and intended use of funds.
1.4. Payment Provider — a payment organization licensed by the National Bank of the Kyrgyz Republic through which payments to the Organization are processed.
1.5. Acceptance — full and unconditional acceptance of the Offer in the manner set out in Section 3.
2.1. The Donor voluntarily and gratuitously transfers to the Organization money in Kyrgyz som as a Donation for the purposes of the Campaign the Donor selects, and the Organization accepts the Donation and undertakes to use it in accordance with its designated purpose (Article 518(3) of the Civil Code).
2.2. The Donation is gratuitous: the Organization provides no goods, work, or services in return (Article 509(2) of the Civil Code). Consumer-protection legislation does not apply to the parties' relationship.
2.3. Campaign purposes conform to the charitable purposes established by Article 1 of the Law of the Kyrgyz Republic "On Patronage and Charitable Activity" of 6 November 1999 No. 119. Donations are not directed to political parties or commercial organizations.
3.1. Acceptance consists of the Donor: selecting a Campaign and a Donation amount on the Website, confirming familiarity with the Offer, and completing payment.
3.2. Completing payment constitutes acceptance of the Offer under Article 399(1) and (3) of the Civil Code. The donation agreement is deemed concluded in written form (Article 176(1) fourth paragraph, Article 395 of the Civil Code) from the moment the Donor's funds are received in the Organization's account via the Payment Provider (Article 394(1) of the Civil Code).
3.3. The place of conclusion is the Organization's registered address (Article 405 of the Civil Code).
3.4. Acceptance of a Donation requires no one's consent or permission (Article 518(2) of the Civil Code).
4.1. The designated purpose of a Donation is the purpose of the Campaign selected by the Donor at payment.
4.2. The Organization accounts for the use of Donations per Campaign and uses each Donation solely in accordance with its designated purpose, subject to Section 5.
4.3. The Organization publishes an annual report on donations collected and their use, as required by Article 12 of the Law "On Patronage and Charitable Activity" and Article 17 of the Law of the Kyrgyz Republic "On Non-Commercial Organizations" of 15 October 1999 No. 111.
5.1. If using the Donation for the Campaign's purpose becomes impossible due to changed circumstances (including: the Campaign's goal is reached early, the Campaign is cancelled, funds raised exceed the target, or the beneficiary no longer needs the aid), the Donor, by making Acceptance, consents to the use of the Donation for other statutory charitable purposes of the Organization closest to the original Campaign's purpose (Article 518(4) of the Civil Code).
5.2. The Organization announces such changes on the relevant Campaign page.
6.1. Donations are transferred via the Payment Provider, which processes payments under its own terms and the payment-system legislation of the Kyrgyz Republic.
6.2. The Payment Provider and/or servicing banks may deduct a processing fee. In that case the amount applied to the Campaign is the Donation minus that fee.
6.3. The Organization does not store Donors' card data; payment data is processed by the Payment Provider.
7.1. A Donation made voluntarily and knowingly is non-refundable (Article 1036(4) of the Civil Code).
7.2. Funds transferred in error (including duplicate payments, wrong amounts, technical failures) are refunded under the Refund Policy published on the Website, on the basis of Articles 1029–1032 of the Civil Code.
7.3. If a Donation is used contrary to its designated purpose, the Donor may demand revocation of the donation under Article 518(5) of the Civil Code.
8.1. The name the Donor provides when making a Donation is displayed on the Website's public pages (in the Campaign's list of donors). The Donor's phone number is not published and is used only to contact the Donor and confirm the Donation.
8.2. The Website's public pages do not show the Donor's phone number, e-mail address, payment identifier, or payment details. Payer identification at the payment layer is performed by the Payment Provider and servicing banks under the anti-money-laundering legislation of the Kyrgyz Republic.
8.3. The Donor's personal data is processed under the Privacy Policy published on the Website and Chapter 11 of the Digital Code of the Kyrgyz Republic of 31 July 2025 No. 178.
9.1. By making Acceptance, the Donor confirms that they: (a) have the requisite legal capacity; (b) lawfully own the funds; (c) act voluntarily, in their own name and interest, or hold proper authority to act for a principal; (d) have read the Offer in full.
10.1. The law of the Kyrgyz Republic governs the parties' relationship.
10.2. The Organization may amend the Offer by publishing a new edition on the Website. The new edition applies to Donations made after publication; earlier Donations remain governed by the edition in force at the time of payment.
10.3. Invalidity of any provision of the Offer does not invalidate its remaining provisions.
